What is a typical visitation schedule?
Sunday, April 8th, 2007Although there is no example of a typical visitation schedule provided for in the statute, there are some visitation schedules that we see time and time again. An example of this type of schedule, would be alternating holidays and alternating weekends. It can also include a day or two during the week, as well as extended visitation time in the summer months and Christmas holiday months. In the past, parties used to provide a clause which stated reasonable visitation would be allowed. The courts have recently frowned upon this expression “reasonable visitation” because it was too vague. Parties were coming back into court post-petition, seeking redress of visitation issues. Most judges today, require a specific visitation schedule to be spelled out in the judgment for dissolution of marriage before any order of finalization can be entered. What this does is provide a structure for the parties. It takes the guesswork out of visitation and it lays it out in black and white as part of the judgment.
